Tracer Terms of Use

The short version

Tracer is a time tracking app for personal use. Your data stays on your device unless you choose to export, import, share, or send it somewhere else. Use the app lawfully, do not try to reverse-engineer it, and understand that it is provided without warranties. Tennessee law governs this agreement except where mandatory consumer law gives you rights that cannot be waived.

1. Agreement and scope

By downloading or using Tracer, you agree to these Terms of Use. If you do not agree, do not use the app.

These Terms of Use govern your use of Tracer and are published on our website as a standalone reference. Tracer is currently distributed for beta testing through TestFlight and may later be distributed through Apple’s App Store. TestFlight distribution is governed by Apple’s TestFlight Terms of Service. If Tracer is distributed through the App Store, App Store distribution will be governed by the Apple Media Services Terms and Conditions and Apple’s standard Licensed Application End User License Agreement (EULA), unless a custom EULA is separately adopted in App Store Connect. Apple, Inc. is not a party to this agreement.

2. License

Invisible Sloth, LLC grants you a limited, non-exclusive, non-transferable, revocable license to use Tracer on Apple devices you own or control, subject to the Usage Rules in the Apple Media Services Terms and Conditions. We reserve all rights not expressly granted.

3. Your data

All data you create in Tracer – activities, time entries, notes, and preferences – is yours. It is stored locally on your device. Invisible Sloth, LLC does not automatically collect it, store server copies of it, or sell it. For details, see our Privacy Policy.

Tracer includes data export and import. When you export, you choose where to send the exported file through the iOS share sheet, such as Files, email, or another destination you select. You are responsible for exported files once they leave Tracer. When you import, Tracer reads the JSON backup file you choose and restores it locally on your device.

4. Acceptable use

You may use Tracer for lawful personal time tracking purposes. You agree not to:

  • Reverse-engineer, decompile, or disassemble the app, except to the extent that applicable law grants non-waivable interoperability rights that cannot be restricted by contract
  • Attempt to extract the source code
  • Modify, adapt, or create derivative works
  • Use the app in any way that violates applicable law
  • Interfere with the app’s security features

5. Children

Tracer is a general-audience app and is not directed to children under 13. We do not knowingly collect personal information from children under 13 through the Tracer app.

6. Intellectual property

Tracer, the Tracer name, and all associated branding are the property of Invisible Sloth, LLC. Nothing in these terms transfers any intellectual property rights to you.

7. Disclaimer of warranties

To the extent permitted by applicable law, Tracer is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • The app will be uninterrupted, error-free, or available at all times
  • Time tracking data will be accurate or complete
  • The app will meet your specific requirements
  • Data will not be lost due to device failure, software bugs, user action, backup settings, import/export choices, or other causes

You are responsible for maintaining your own backups of any data that matters to you.

8. Limitation of liability

To the fullest extent permitted by applicable law, Invisible Sloth, LLC and its current and former members, managers, officers, directors, employees, contractors, representatives, agents, affiliates, successors, and assigns will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, profits, or goodwill, arising out of or relating to your use of, or inability to use, Tracer, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from these terms or your use of Tracer will not exceed the amount you paid to Invisible Sloth, LLC for Tracer in the twelve months preceding the claim, if any.

Nothing in these Terms limits any consumer rights you may have under applicable law that cannot be waived by contract.

9. Third-party information

The following is provided for transparency and is not binding on you: Tracer uses GRDB, an open-source library provided under the MIT License, solely for local SQLite database access on your device. GRDB makes no network calls and imposes no third-party terms on users. Your use of TestFlight remains subject to Apple’s TestFlight Terms of Service, and any future use of the App Store remains subject to the Apple Media Services Terms and Conditions and Apple’s other applicable terms and policies.

10. Availability and discontinuation

To the extent permitted by applicable law, Invisible Sloth, LLC may modify, suspend, or discontinue Tracer in whole or in part, including specific features, for product, security, legal, or operational reasons.

11. Changes to these terms

When we make material changes to these terms, we will post the revised Terms of Use at this URL with an updated effective date. A short changelog is maintained at the bottom of this document. Continued use of Tracer after changes take effect constitutes acceptance of the updated terms.

12. Governing law and disputes

These terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. Any disputes arising from these terms or your use of Tracer will be resolved exclusively in the state or federal courts located in Tennessee, and you consent to personal jurisdiction in those courts. Where mandatory consumer law grants you the right to bring claims in your local jurisdiction, this section does not limit those rights.

Before initiating any formal dispute, we ask that you contact us at support@invisiblesloth.com so we can try to resolve the issue informally.

13. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and Invisible Sloth, LLC only regarding Tracer and supersede any prior agreements between you and Invisible Sloth, LLC on that subject.
